Inheritance, will and trust disputes
Fiona joined Veale Wasbrough Vizards in 2002, having trained and qualified at Thring Townsend in 2000. She has many years experience dealing with all types of contentious trust and probate disputes, and practices exclusively in this area.
Fiona's clients range from private individuals including executors, administrators and beneficiaries, to professional trustees and executors.
Examples of recent cases
- Successfully negotiating a multi million pound settlement at a mediation on behalf of a partner of the firm who was the Court appointed Administrator of an English estate, which had an interest in a Swiss Estate. This was a complex multi party dispute involving proceedings being issued in both jurisdictions against the former executor of the Swiss Estate for misappropriation of monies and valuable works of art.
- Acting for a cohabitee in a claim under the Inheritance (Provision for Family and Dependants) Act 1975, achieving a successful settlement of the case by overcoming the legal hurdle of the "same household" test, despite the fact that the claimant cohabitee had a separate address to the deceased and regularly spent a certain amount of time at this property.
- Acting for the beneficiary under his late father's Will in multi party Construction proceedings, including advising on a breach of trust claim against the executor of the estate for failure to properly administer or invest the trust.
