Federations and collaboration

Veale Wasbrough Vizards advises all types of maintained schools including community, foundation, voluntary aided, voluntary controlled, trust, nurseries and early years providers, special schools and academies. We also advise further education and higher education institutions.

Lawyers within our Education team can advise groups of two or more schools wishing to federate. Federations share one governing body and may have an executive head with overall responsibility for the schools within the federation. Alternatively schools may want to consider a more informal arrangement such as a cluster.

Our lawyers have experience dealing with:

  • advice on advantages and disadvantages of joining or establishing a federation
  • advice on power of schools to federate under the Education Act 2002 (maintained schools)
  • advice on federations of academies and terms of reference for local governing bodies
  • constitution of new governing body
  • dissolution of existing governing bodies
  • appointment of executive head
  • joint committees of governors
  • consultation
  • staffing issues
  • decisions to leave a federation
  • establishing a joint school based company
  • establishment of a cluster and
  • joint procurement.
