School closure

Lawyers within our Education team can offer advice to governing bodies and local authorities regarding the closure of a maintained school.

School closure can occur for a number of reasons including a falling school roll, cause for concern, merger; acquisition or removal of religious character or if a school is converting into an academy or a new national challenge trust school.

Our lawyers have considerable experience advising on:

  • the School Organisation (Establishment and Discontinuance of Schools)(England) Regulations 2007 (as amended)
  • consultation
  • drafting of formal proposals
  • special considerations for rural primary schools
  • challenges to proposals to close a schools
  • implementation of school closure and
  • formal decision making by governing bodies and local authorities.

We can both support the governing body and senior management team during the process of closure and can offer procedural advice to local authorities where necessary.
