Our team works daily with the legislative regime within which primary health care providers must operate, so we are well placed to advise on all queries that may arise.
We specialise in dealing with compliance requirements for primary care providers, to include GP practices and Any Willing Providers, in particular relating to the Health and Social Care Act 2008 which affects all health and adult social care providers.
Regulatory compliance
We can provide advice and specialist support with registration issues with the CQC and on regulatory compliance with the essential standards of quality and safety set by the Act. We also provide pragmatic and practical advice on health and safety issues affecting practices.
We provide ad hoc advice when required by practices, assist with the development of bespoke and practical policies and procedures, help prepare for inspection and assist practices to deal effectively with your regulators.
In the event of non-compliance being identified, whether on self-declaration or by regulators such as the CQC we can assist in:
- Challenging inaccurate inspection reports and CQC decisions to refuse registration or impose unnecessary compliance conditions.
- Challenging enforcement notices served by the HSE or local authority.
- Assisting with the preparation of action plans to achieve compliance and reduce the likelihood and magnitude of sanctions.
- Representing you in enforcement and linked proceedings, such as inquests and public enquiries.
We also provide a wide range of sector specific training and are regular speakers at conferences and seminars and contributors to relevant publications.
Critical Incident Management
We provide practical support and assistance following critical incidents within the practice such as safeguarding issues and fatal accidents to include:
- reporting requirements
- governance issues
- communication issues and public relations
- internal investigation and reports
- data retention, disclosure and confidentiality
- liability and liaison with insurers
- representation at police station interviews, inquests or public enquiries
- defence of related civil claims for compensation
- defence of prosecutions brought in the criminal courts.
