We are respected advisers of both planning authorities and developers. We regularly advise local planning authorities on complex planning and infrastructure agreements including advising on developer contributions for education, highways, and affordable housing. For local planning authorities we have defended judicial review proceedings and pursued enforcement action. For developers we have conducted significant planning enquiries. Where appropriate, we have been robust in challenging breaches of procedural policy on behalf of private sector clients.
Our recent work includes:
- acting on behalf of the Ministry of Defence in respect of its £800 million Corsham Development Project, providing planning advice and drafting the unilateral undertaking with adjoining landowners in order to meet with the requirements of the local highway authority and culminating in the grant of the planning permission required for the development
- advising Hills Waste Solutions Limited in its negotiations with Wiltshire County Council in connection with the planning application required for the Mechanical Biological Treatment plant and waste treatment service. This also involved dealing with Natural England over the requirement for a licence to translocate a badger sett that was found on-site
- advising West Wiltshire District Council under the Commons Act 2006 on an application to register part of its land as a town or village green. Drafting and lodging an objection on behalf of the Council to persuade the relevant determining authority to reject the application
- acting for Cardiff County Council in respect of footpaths, diversion order and stopping up orders
- advising Bristol City Council in connection with Bristol Harbourside redevelopment on the negotiation of the first planning agreement which secured:
- the making of planning gain payment
- the provision of infrastructure including highways
- the provision of a harbour inlet and public amenity areas and walkways and public art
- the provision of affordable housing
- green travel plans
- maintenance arrangements in relation to the amenity areas which the Council will not be adopting
- acting for Bristol City Council in relation to the complex section 106 agreements which have either been completed and/or are still required as the developers continue to develop successive phases of the Bristol Harbourside site for mixed commercial, office leisure and residential use and further changes are negotiated to the master plan
- advising Cardiff County Council on the duties and powers of Highway Authorities in respect of consents and approvals required to cross tidal waters and making an application under section 106(3) Highways Act 1980
- giving planning advice to City Academy Bristol and negotiation of complex highways and planning agreement including substantial highway works commuted payments by Department for Education and Skills (DfES).
