Learning difficulties and Disability

We find that increasing numbers of Further Education providers are seeking advice on this sensitive area.

Learning Difficulties may not always amount to a disability under the Disability Discrimination Act 1995 (as amended) but in many cases they do.

Further Education providers may face challenges in connection with:

  • Admission policies and procedures
  • Access to the curriculum and buildings
  • Disciplinary procedures

We provide template policies on learning difficulties and template accessibility plans which are a statutory requirement.

We have experience of defending Further Education providers against claims of Disability Discrimination brought in the County Court and have successfully negotiated settlements in others.
