We find that increasing numbers of schools are seeking advice in this sensitive area.

Special educational needs may not always amount to a disability under the Disability Discrimination Act 1995 (as amended), but in many cases they do.

Schools may face challenges relating to:

  • Admissions Policies and Procedures
  • Access not only to buildings but also to the curriculum
  • Disciplinary procedures.

We provide template policies on special educational needs and template accessibility plans, which are a statutory requirement.

We have defended several claims against schools at the Special Educational Needs & Disability Tribunal (SENDIST) and successfully negotiated settlements in others.

We have provided material on special educational needs for Croner's online resource for independent schools and have contributed several chapters to "Schools for Special Needs" published by Gabbitas.
