Often parents will complain about the Local Authority or school failing to make the special educational provision which is set out in a Statement of Special Educational Needs, or if the Local Authority fails to comply with the timescales for the conduct of assessments, making statements or complying with other identifiable legal obligations. This may result in the threat or issue of judicial review proceedings.
We advise and assist in resisting these applications by providing appropriate responses to Pre-Action Protocol letters and, if proceedings are issued. by filing an Acknowledgement of Service and drafting Grounds of Resistance to resist permission being granted at the first stage of the process.
If permission is granted we will advise on the process and all the necessary evidence on behalf of the Local Authority to resist the application at a full hearing.
