Licensing

The implementation of the Licensing Act 2003 presents all those involved in the licensed trade with a new set of challenges and opportunities. The process of converting existing licences to the new regime has answered some of the questions raised by the new system but there are still some areas of confusion.

We have a detailed understanding of the new regime and will provide you with pragmatic and commercial licensing advice to allow you to maximise the effectiveness and profitability of your business.

We can advise you on all aspects of the 2003 Act, including applications for new premises licences, variations and temporary event notices and the bringing or defending of licensing prosecutions. We have significant experience of advising both public and private sector clients on licensing issues at all levels, including hearings at the Licensing Authority, Magistrates' Court, Crown Court and High Court.

In addition to our expertise in relation to the supply of alcohol and the provision of regulated entertainment and late night refreshment under the 2003 Act, we can also advise on other licensing matters that may affect you, including civil marriage licences and gaming law.

Police Authorities

Our licensing lawyers have significant experience of acting for the police in preparing considered objections to licensing applications and in bringing revocation proceedings. Our in depth understanding of the new law allows us to work effectively with the police on actual or potential problem premises by considering appropriate licensing hours, activities and conditions. We can also prosecute licensing offences on behalf of the police.

Local Government

We have a detailed understanding of the new regime from the Licensing Authority's perspective and provide regular seminars and lectures on behalf of the Local Government Training Partnership. We have provided advice to various authorities on numerous aspects of the implementation and operation of the Licensing Act 2003. We can also advise on the implementation of the Gambling Act 2005.

The licensed trade continues to be a vibrant and fast moving sector. All those involved have generally coped well in adjusting to the demands of the new licensing regime under the 2003 Act.

We can now help you to take advantage of the new flexibility and develop your business to its full potential."
