Procurement & commercial contracts

Our team members have substantial experience of commercial law work for local government. We have advised on EU and domestic procurement rules and state aid e.g. on inclusion of social clauses, local produce preferences, post tender negotiation and use of soft market testing.

We carry out both routine contractual work and advice on more bespoke contracts (in all cases including provision of EU and best practice procurement and state aid advice) for many local authorities and other public bodies. Our work ranges from reviewing and advising on standard terms and conditions of trading to significant commercial projects and contracts by bodies such as MoD, the Home Office and the Department of Transport.

We have extensive experience of public sector construction contracting and dealing with all standard construction forms including newer collaborative models such as EEC (including amending options for use as term contracts) and PPC for public sector clients including procurement regulation in construction.

Work experience/case studies:

  • Advising a Borough Council in respect of establishment of an incubator serviced business park for start up companies involving funding from RDA, ERDF and DTi, including the negotiation of development agreement and operating contract tied to a 40 year term lease.
  • Advising a County Council under a call down contract on various commercial agreements and procurements including in relation to the procurement of a new care home and for various services including marketing and recruitment services including e-auction procurement where the Council was the lead authority of a consortium of authorities.
  • Advising a County Council upon the procurement issues arising from the construction of its £12 million Heritage Centre for county archives under JCT 'WCD '98.
