Separation agreements

It is very common for people to recognise the need to separate and yet one or both is not ready to go straight to a divorce.

The parties may recognise that the marriage/partnership has irretrievably broken down and yet may wish to deal with a divorce in a non-confrontational Petition based, on say 2 years separation by consent.

We can advise you on the ways in which a separation agreements may assist and can guide you through the entire process. We will negotiate and agree the terms of the agreement on your behalf.

A Separation Agreement can help make provision for a future divorce/dissolution while in the meantime regulating the relationship and agreeing ongoing financial commitments.

As the law stands such Separation agreements will, if properly constituted, be recognised by the Court as binding on the parties in any future divorce proceedings.
