Defending employment tribunal claims and identifying the risks 

Our Employment lawyers work with employers at the early stages of a dispute to identify the risks and the approach to a claim. It is important to assess how much a claim is worth and how much resource you want to dedicate to defending the claim. There are very limited grounds upon which an employer can seek to recover costs in the employment tribunal.


Commercial settlements and minimising costs

We will work with you to minimise the costs and achieve commercial settlements where that is appropriate for your business. We also recognise that for business or policy reasons, you may need to fight some cases (sometimes regardless of the merits of the case).


Guidance defending employment tribunal proceedings

If you are defending a claim, we will work with you to prepare a robust response and provide guidance on the various stages of the employment tribunal proceedings. At the end of a claim, we will review with you any potential training needs/policy changes and development.

We will also conduct a three hour detailed session with those involved in the claim with a view to everyone learning from the experiences of the action.

The policy can cover:

  • awards, settlement and legal cost from the date of any potential dispute arising
  • awards, settlements and legal costs from the date employment proceedings
