Recent work

  • Advising Airbus on the £70m redevelopment of its site in Filton, Bristol, to create the Airbus Aerospace Park.  The project includes new build offices for approximately 2500 employees, a new build data centre and the extensive refurbishment of a grade II listed art deco building.
  • Acting for the Ministry of Defence (MOD) on the construction issues involved in a £800m PFI project for the redevelopment of the MOD's facility at Corsham, Wiltshire.
  • Representing Airbus regarding the contract for the design and construction of a £75m 46,000 square metre composite assembly factory in Broughton, North Wales for the Airbus A350 wings.

There is continuing pressure on academic institutions to undertake projects either to update their existing facilities or to build new ones.

Construction projects of all kinds represent a significant investment in both time and money and any disruption in the completion of the project, or operation of the facility can have a serious impact upon the planned academic programme. This means that it is important to get it right first time.

Our team of construction lawyers has experience of acting for both GPs and funders in relation to the development of numerous new GP surgery premises. This enables us to understand the challenges faced by GPs and primary care providers at each stage of the construction process, from the design, procurement and funding of the development through to completion and occupation.

Construction Documentation

We have a detailed knowledge of the standard forms of building and engineering contracts (NEC, JCT, ICE, ACA, GC Works and FIDIC), sub-contracts and professional appointments (RIBS, ACE and RICS forms) and we regularly advise upon risk allocation, insurance, quality, time and payment issues.

With our experience we can advise if a particular clause is likely to be acceptable to the other contracting parties and give you guidance upon current benchmarks in the healthcare sector.

Construction Security

When lending to GPs for the development of new GP surgery premises, a funder is likely to require construction security to help protect its loan. A funder may also require "step-in rights" which allow the funder to step-in and complete the works when an employer becomes insolvent or commits a breach of the building contract prior to completion of the development.

Funders typically require collateral warranties from those parties who designed and built the new development. We can assist by procuring collateral warranties from the relevant parties and ensuring that the collateral warranties and the building contract/professional appointments/sub-contracts are back-to-back.

Public Sector

Local Government

Successful delivery of construction projects is at the heart of any local authority's property management strategy and we have assisted over 46 local authorities achieve their objectives. Our advice has covered facilities management, maintenance and refurbishment as well as new build projects.

Central Government

We have advised over 15 central government departments and non-departmental public bodies (including Defence Estates, the MOD, the Environment Agency and the National Assembly for Wales) on the procurement and delivery of a broad range of construction and engineering projects.
