In February 2016, the Ministry of Justice ('MoJ') published a consultation on proposals to reform the current fixed fee structure for personal representatives applying for a grant of probate or representation.
At present, applications for grants, for estates valued at more than £5,000, are fixed at £155 when made by a legal representative and £215 when the application is made by an individual. Personal representatives of estates that require probate but are worth less than £5,000 do not have to pay a fee.
The MoJ is now proposing to increase the value of the estate below which no fee is payable from £5,000 to £50,000 and to introduce a banded fee structure for all estates worth more than £50,000 and the fee is proportionate to the size of the estate.
