Celebrating Family Mediation Week

on Friday, 21 January 2022.

During the week of 17 to 22 January 2022, we will be joining our fellow members of Resolution to Celebrate Family Mediation Week. Our lawyers will be attending specially designed training sessions to learn more about mediation and its benefits.

What Is Mediation?

Mediation is an alternative way of resolving matrimonial disputes away from the family court. Mediation is conducted by a neutral and impartial person (a 'mediator') who is there to help guide you through your negotiation. They are there to help everyone involved find a solution. Mediation can be used to talk about a divorce, how matrimonial assets will be divided and child arrangements.

What Are the Benefits of Mediation?

Mediation can be beneficial to separating couples because:

  • It can often be quicker and less expensive than engaging lawyers or determining your case in court.
  • It allows parties to take control of the negotiations and the outcome. By engaging in legal proceedings the overall outcome (if a prior settlement is not agreed) is in the judge's hands. It may be that the parties are then bound by an outcome that neither of them are particularly happy about.
  • It can feel a lot less confrontational than initiating court proceedings. Often court proceedings can damage the relationship between the couple further, particularly when the dispute concerns child arrangements.
  • The process will help guide the parties through their dispute with both parties having an equal opportunity to be heard.
