Coronavirus - Most Recent Update to Job Retention Scheme Guidance

On 30 April, the Government issued its latest update to the job retention scheme guidance.

The guidance now makes it clear that employees can carry out functions as employee representatives and accompany other employees in redundancy consultation meetings whilst furloughed.

The key paragraph is:

"Whilst on furlough, employees who are union or non-union representatives may undertake duties and activities for the purpose of individual or collective representation of employees or other workers. However in doing this, they must not provide services to or generate revenue for, or on behalf of your organisation or a linked or associated organisation."

This is welcome clarification on an issue that has been the cause of some concern.

Further amendments include:

  • directors with annual pay can qualify for the scheme
  • a new employer can claim under the scheme in respect of employees of a previous business who TUPE transferred after 28 February 2020
  • confirmation that if an employee was furloughed and then started family related leave after 25 April 2020 organisations can claim for enhanced earnings related contractual pay
  • confirmation that periods of furlough can be extended
