Employment Tribunal Refunds - Scheme Opens in Full

Following our earlier article, it has been announced by the government that the employment tribunal refund scheme will now be rolling out in full. The initial phase of the scheme, which was open to up to 1,000 people, began on 20 0ctober 2017.

Key Points to Note

The refund scheme is open to both claimants and respondents. It covers fees paid to the Employment Tribunal and the Employment Appeal Tribunal from the start of the fee regime in 2013 to its abolition this year.

You are eligible for a refund if: 

  • you paid a fee directly to the Employment Tribunal or Employment Appeal Tribunal, and have not been reimbursed by your opponent pursuant to an order of the tribunal

  • you were ordered by the tribunal to reimburse your opponent their fee and you can show that you have paid it

  • you are a representative (such as a trade union) who paid a fee on behalf of another person and have not been reimbursed by that person

  • you are the lead claimant (or representative) in a multiple claim and paid a fee on behalf of the other claimants

Those eligible for a refund can apply online or by post. 

  • If applying by post, there are a number of different refund forms: 1-C is for claimants, 2-R is for respondents and 3-S is for representatives, sponsors and lead claimants in the case of a multiple claim.

  • If you apply by post, be careful to ensure that you use the correct form.
