Update - Fee Remission Process

HM Courts and Tribunal Service ('HMCTS') has made changes to the existing fee remission process for individuals making employment tribunal claims

The fee remission process helps individuals who are on benefits or have a low income to bring employment tribunal claims by applying a full or partial fee remission for those individuals who meet the eligibility requirements.

The new process, which is called 'Help with Fees', took effect from 28 October 2015 and includes a new online form. HMCTS has made the process faster and simpler. Applicants will need to make a self-assessment of their eligibility in the form and will no longer have to initially submit paperwork to support their application for help with fees. HMCTS will instead check an applicant's income and whether they are on qualifying benefits directly with the Department for Work and Pensions. Some applicants may still however be asked to provide paperwork including evidence of their income and benefits documents at a later stage.
