Act Now or Risk Financial Penalties
It is estimated that 15,000 UK businesses need to comply with ESOS, and all must report their energy use for the first assessment period by 5th December 2015. However, the majority of qualifying businesses are either unaware of ESOS or are yet to notify the Environment Agency of their compliance.
Businesses which fail to meet the 5th December deadline may face financial penalties of up to £50,000, with an additional daily fine of £500 for as long as they fail to comply. They also run the risk that their non-compliance will be publicised.
Our team of energy lawyers can help you determine whether ESOS applies to you, taking into account the limited exemptions. Factors including group structure can also lead to uncertainty as to whether a business is caught by ESOS. We are on hand to explain how your legal structure relates to the scheme criteria.
