STOP PRESS: European Commission Publishes New Standard Procurement Forms

The European Commission has now published new and revised standard forms for advertising public sector contracts, concession contracts, utilities contracts and defence and security contracts in the Official Journal of the European Union.

The forms are contained within the Commission Implementing Regulation (2015/1986/EU).

The forms that relate to the new public sector directive (Directive 2014/24) and the Public Contracts Regulations 2015, are set out below:

  • Annex I. Standard form 1: Prior information notice
  • Annex II. Standard form 2: Contract notice
  • Annex III. Standard form 3 : Contract award notice
  • Annex VIII. Standard form 8: Notice on a buyer profile
  • Annex IX. Standard form 12: Design contest notice
  • Annex X. Standard form 13: Results of design contest
  • Annex XI. Standard form 14: Corrigendum
  • Annex XII. Standard form 15: Voluntary ex ante transparency notice
  • Annex XVII. Standard form 20: Modification notice
  • Annex XVIII. Standard form 21: Social and other specific services

Where procuring under the new public sector directive and the Public Contracts Regulations 2015, the new and revised forms should be used to ensure compliance.

The current forms relevant to concession contracts, utilities contracts and defence and security contracts are repealed with effect from 18 April 2016.

Practically, authorities will want to ensure that their standard procurement documentation and portals are updated to reflect the new forms and are being used consistently.
