Third Party Rights vs Collateral Warranties

A purchaser or tenant of a newly built property will customarily expect a collateral warranty from the contractor and the design professionals.

It has taken many years for the Contract (Rights of Third Parties) Act 1999 to become widely accepted by institutional investors, funders, developers and insurers.

The session will cover the differences between third party rights and collateral warranties and highlight the advantages and disadvantages of each.

Case Law Update
 
The last few months has been a fruitful period for interesting cases, this session will explore the answers to difficult questions such as 

  • Can a binding contract for the sale of land be created by an exchange of emails?
  • can a contract between a seller and an estate agent be entered into verbally? 
  • can a landlord be forced to accept the surrender of a lease if the tenant goes into a CVA?
  • can one acquire land by adverse possession, even though it hasn't even got a fence round it?
