Find out about key data protection topics and what schools should be focusing on now that the GDPR applies.

This session will cover issues specific to independent schools such as:

  • The new and enhanced rights which exist under the GDPR and the Data Protection Act 2018 (DPA 2018). This includes the 'right to be forgotten' and subject access requests (SARs) made by pupils, parents, staff and others. Individuals will often use their data rights for tactical reasons, for example, in order to try and force disclosure of information which might assist them in a dispute with a school. Our training includes practical guidance on how best to manage SARs and other requests as well as advice on how to apply the exemptions from disclosure.
  • Specific issues around children and data protection, such as consent, health and social services records and under what circumstances information should be witheld from parents/guardians. We will look at the new provisions in the GDPR/DPA 2018, which are intended to make it easier for schools to manage pupil data.
  • Data breaches, including when and how to report and lessons learnt from when we have seen things go wrong in a school context. We will also touch on the wider regulatory framework, for example, the requirement in some cases to report a breach to the Charity Commission.
  • Monitoring staff and pupils, for example, keeping track of staff and pupil internet use, reading staff emails, CCTV and under what circumstances it is permissable to make covert (secret) recordings.
  • Information security, for example, home/remote working, use of tablets/mobiles by staff and storing information using cloud based services.
  • The GDPR record keeping requirements.

Data protection has become increasingly important, with maximum fines of the higher of €20 million and 4% of worlwide turnover.

The risks have increased recently as new technology and ways of working have meant that schools are handling information in ever more sophisticated ways. Pupils, parents and staff are also more aware of their information rights and willing to report non-compliance to the Information Commissioner's Office.

We will provide an interactive session incorporating case studies based on real examples and group problem sharing, with a strong focus on practical solutions.

The training will give delegates a practical understanding of how data protection issues should be managed in an independent school context.
