Legal support challenging or contesting a Will

Are you concerned that a person may have made a Will that leaves you out because of the influence of a family member, carer or other person who has become close to the deceased in their later years of life?

Or perhaps you feel you have been left out of a Will because the deceased was elderly and you think they did not have the necessary mental capacity to make a Will?

How we can help

We can assist you in challenging or defending disputes about these sorts of Wills. Challenges to Wills can be made on a number of grounds, such as:

  • a lack of mental capacity
  • the influence of the person who takes the lion's share of the Will (what we call 'undue influence')
  • the Will not being properly signed or witnessed (what we call 'lack of due execution')
  • the person who made the Will not knowing or agreeing to the terms of the Will they signed (what we call 'lack of knowledge and approval')
  • the Will not having been properly drafted (what we call 'a negligent Will').

Funding

We understand that clients are sometimes unable to find the immediate funds necessary to begin court proceedings. We carefully assess the costs and risks at the outset of any case, and are always happy to discuss appropriate financial solutions.

We provide a national service to private clients via our offices in London, Watford, Bristol and Birmingham. For clients based in North Bristol, we also have a dedicated office at 106 Henleaze Road.
