What is a personal injury claim?

A personal injury claim is a legal process that arises when someone suffers harm due to another party's negligence, which means failing to take reasonable care to avoid causing injury or loss. This can include accidents at work, road traffic accidents, or cases of medical negligence. Personal injury claims allow individuals to seek personal injury compensation for a wide range of losses, including:

  • Physical injuries such as pain and suffering, medical expenses and rehabilitation costs.
  • Economic losses such as lost wages, future earnings, and property damage.
  • Other damages such as loss of amenity (the enjoyment of life) and emotional distress.

Making a personal accident or medical negligence claim can feel daunting, you deserve a personal injury or medical negligence solicitor who will be there with you every step of the way, focused on making a real difference in your recovery journey.

How much does a personal injury lawyer cost?

We believe everyone should have access to justice without financial risk. That's why many of our cases are run on a no win no fee basis. This means you won't pay our personal injury lawyer fees if your claim is unsuccessful.

If your claim succeeds, we charge a capped no win no fee percentage (never more than 25% of your compensation). We never deduct fees from future financial losses, such as your future earnings.

We will always explain your options clearly, including other funding routes such as legal expenses insurance, so you know exactly what to expect regarding personal injury lawyer fees or overall personal injury lawyer cost.

How long does a personal injury claim take?

The length of a personal injury claim varies depending on the complexity of your case and whether liability is disputed. On average, claims take between 1-2 years to settle.
Some of the most common questions we answer are:

  • How long should a personal injury case take to settle?
Most cases resolve within 12-24 months.
  • How long does it take to get paid after a settlement?
Once agreed, payment is usually made within a few weeks.
  • How long does it take to settle a car accident case?
Straightforward cases can settle faster, but serious injury claims often take longer due to medical evidence.
  • How long after an accident can you file a claim?
Usually within three years, although exceptions apply for children or those lacking capacity.

FAQs

Do you believe you have been injured as a result of the negligence of another person or organisation?  Have you been injured as a result of an accident that was not your fault? If so, you might be entitled to compensation.

We will be able to advise you on whether the other party is likely to be found responsible and therefore whether you have a reasonable case.

Generally speaking, you can claim for two things.

First, you can claim for your actual injuries, the pain and suffering that you have experienced, and how your injuries have affected different aspects of your life, such as your working life and social life. How your injuries might affect you in the future is also considered.  In most cases we obtain specialist medical reports regarding your injuries.

Secondly, you can also claim for past and future financial losses and expenses.  For example, loss of earnings and the cost of treatment.

If you have had an accident then the usual rule is that unless your claim has settled, court proceedings have to be commenced within three years of the date of the accident.

If the injured person was a child at the time of the accident then usually the child has three years from their 18th birthday to have commenced court proceedings.

If you lack capacity, possibly because you have sustained a head injury, the three year time limit may not apply to you. It is best to take early advice on this question.

The time limit is not always three years - for example if the accident happened at sea.

More complex rules apply to industrial disease cases.

If you think you might have a claim then the best thing to do is to call us straight away. Our specialist personal injury solicitors can advise you about the time limit that applies to your case.

A No Win No Fee agreement (or a Conditional Fee Agreement) is an agreement which protects you against having to pay legal fees if you lose your case. Regardless of how your case is funded we will always keep you informed of your costs all the way through your case and we will always answer any questions you may have about costs as the case progresses.

How your injuries might affect you in the future is also considered. In most cases we obtain specialist medical reports regarding your injuries.

How much compensation you will get very much depends upon what injuries you have suffered from, how they have affected you and how they might affect you in the future.

Our specialist personal injury solicitors will ensure that you claim everything that you are entitled to claim.

We will give you advice about how claims are valued and how much your claim is worth.

We have accumulated an enormous amount of experience over the years and we will use this to your advantage in terms of getting as much compensation for you as possible.

If you are successful with your claim, we will deduct a success fee from your compensation. The amount of the success fee is case dependent. However we can guarantee that we will deduct no more than 25% of your compensation. Also, we never deduct our success fee from any future financial losses at the time of settlement, for example your future loss of earnings.

It is of course completely up to you if you decide you would like legal representation, although we would highly recommend it. As experts in our field we can get the best outcome for you. It is more than likely you will get more compensation if you use a solicitor as opposed to trying to represent yourself.

Very few cases end up in a court room.

If the Defendant admits liability then the overwhelming majority of cases settle without the need to go to court.

In the unlikely event that your case actually goes to court, our specialist personal injury solicitors will support you and explain what will happen.

Not everybody who is injured is capable of dealing with a compensation claim. In some cases you can bring a claim on someone else's behalf, for example a child or for someone who lacks capacity.

On average it takes between 1-2 years for a case to settle. It will depend on whether a claim is disputed. We will give you an estimate as to how long we think a case will take at the start and update you throughout. We will always ensure that a claim is resolved as soon as possible.

It very much depends on the circumstances of the claim. It is best to speak to a lawyer, and they can discuss with you your chances of being successful.

Our work highlights

1

Raymond Scott -v- UKRI - trial

We acted for a Claimant who sustained a serious cold injury while working for the British Antarctic Survey.

The case was fully defended and went to a seven-day trial with over a dozen witnesses. We won and our client was awarded substantial damages including future loss of earnings.

2

Head Injury

The team acted for a man who sustained a head injury when he was knocked off his bicycle by a motorist.

He was unable to continue work as a consulting engineer. The case settled for over £3m in damages, mostly for future loss of earnings.

3

Spine surgery

We acted for a Claimant who had surgery on their spine.

The surgeon did not operate on the correct level in their spine and as a result they had to have further surgery which they would not have needed had the surgery been done correctly in the first place.  As a result the Claimant was left with ongoing pain. We won the claim and the Claimant was awarded damages.
