Our work highlights

Divorce  

  • We challenged an application made by the respondent in divorce proceedings, to obtain a final order, before the parties had agreed the terms of a financial settlement.  We negotiated protective measures for our client, which enabled the divorce to proceed without financial detriment to our client.

Finance

  • After discovering suspicious transactions in the husband's bank statements, we issued an urgent application and secured an order for the husband to pay to the wife, a proportion of the net sale proceeds of a property, pending determination of her financial settlement.  We also secured an order for the husband to pay to the wife, monthly maintenance for her outgoings and legal fees, during the financial proceedings.
  • The joint expert instructed by the parties, to value the husband's company, provided a low valuation, due to flaws in the methodology used.  We successfully issued an application for permission, from the court, to instruct a new expert to value the company. The valuation produced was higher and we were able to rely on this to negotiate a more favourable settlement for the wife.

Children

  • We acted for a father, in Children Act proceedings, where the mother had abducted the child to  the other side of the country and sought to remain living there. We successfully argued, on behalf of the father, for the immediate return of the child and a 'lives with' order in his favour.
  • We acted for a father in an application made by the mother, for Non Molestation (NM), Occupation (O) and child arrangements.  The mother was attempting to reduce the children's time with the father.  Upon advice, the father contested the application and the mother then withdrew her NM and O applications.  The child arrangements application concluded with an order for shared care, providing the children to spend equal time with both parents, which was much more than the mother was offering.
  • We acted for a mother in Children Act proceedings, which included allegations of alienation against her. The mother denied such allegations and argued that the children's refusal of contact was as a result of the father's behaviour.  We successfully argued in favour of the mother and the court decided that the children should live with the mother and have indirect contact with the father, until they were ready to engage in a relationship with the father.

Cohabitation

  • We acted for a partner, where his ex-partner issued injunctive proceedings against him, based on some serious allegations.  After preparing a detailed and well-argued statement in his defence, his ex-partner withdrew her application at the first hearing.
  • We acted for a partner in relation to a property that he owned in his sole name but was occupied by his ex-partner for a short period.  His ex-partner argued various contributions that she had made and wanted a 50% share of the property.  We settled the dispute, in an all-day mediation. with the ex-partner receiving a lump sum which was approximately 15% of value of the property.

Nuptial agreements

  • We are assisting a husband, who will be receiving substantial sums from his parents' business.  He and his parents are concerned that the wife could be entitled to receive a share of the business, if they separated.  In order to protect the husband's wealth, we are preparing a post-nuptial agreement for him, being mindful of the factors that a court will consider, to uphold the agreement.
