Kate is an associate in our Contentious Probate and Trusts team.

Kate represents private clients, trustees, executors, and charities in a broad spectrum of contentious probate and trusts matters, including inheritance, will, and trust disputes. 

She advises on a wide range of issues, including challenges to the validity of wills and trusts with the removal of executors and trustees. Kate also handles claims under the Inheritance (Provision for Family and Dependants) Act 1975 and is experienced in dealing with claims involving proprietary rights, proprietary estoppel and mismanagement or maladministration of trusts and estates. She has experience advising on charitable disputes and the rectification of wills and trusts.

Kate worked as a commercial litigator for a number of years before developing a contentious trusts and probate practice. Her time spent in commercial law developed her abilities in case strategy and technical expertise. Contentious probate combines such complex legal analysis with very human elements, often involving family dynamics, emotional challenges and sensitive issues around inheritance.  Kate finds the opportunity to help clients through some of their most difficult times, resolve disputes and ensure that their rights are protected highly fulfilling. 

Kate has been involved in the following reported trust and charity cases:

  • acting for the Trustees in Viavi Solutions UK Ltd v Viavi Solutions Pension Trustee UK Ltd and another [2022] EWHC 2565 (Ch), Shannan and others v Viavi Solutions UK Limited [2018] EWCA Civ 681 and earlier High Court cases relating to rectification and the construction and validity of pension trust documents
  • acting for the successful Defendants in Fafalios and others v Apodiacos and others [2020] EWHC 1189 (Ch), a case which considered the validity and interpretation of charitable trusts and cy près issues.

Kate is based in the Bristol office but can support you nationally.
