Tom is a Senior Associate in our Commercial team.

Tom qualified in 2004 and his work principally focuses on non-contentious, contractual work in the Pharmaceuticals & Life Sciences sector. 

Tom acts for a range of clients, including multi-national pharmaceutical companies, contract manufacturing organisations, wholesale dealers, parallel traders, service providers and research charities. Tom's non-contentious practice includes drafting and negotiating development, manufacturing, supply, distribution and dossier licence & supply agreements for pharmaceuticals and medical devices.

Tom also advises clients in intellectual property and commercial disputes in the Pharmaceuticals & Life Sciences sector. This work has included Swiss arbitration proceedings concerning a pharmaceutical patent/technology licence dispute, two threatened judicial review proceedings against the MHRA (the Medicines and Healthcare products Regulatory Agency) and a number of contractual disputes.

Tom has particular expertise in advising on parallel trade matters. Tom advises both rights owners and traders on all aspects of the impact of intellectual property rights on parallel trade. This work covers advice on general principles of the exhaustion of intellectual property rights, the BMS trade mark repackaging conditions and the Specific Mechanism. Tom recently acted for a trader client in Intellectual Property Enterprise Court (IPEC) proceedings concerning the parallel trade of a medical device. Tom successfully preserved the right of the client to continue its trade in the medical device, revoked the trade mark asserted by the claimant and obtained an indemnity costs order in favour of the client.

Tom was named as an ''associate to watch'' in intellectual property by the Chambers & Partners legal directory for several years.

Tom is based in our Watford office, but can support you nationally.
