Pharmaceutical list appeal
We assisted a pharmacy client to appeal an ICB decision to allow a combined minor relocation and change of ownership application. The right of appeal was exercised pursuant to the National Health Service (Pharmaceutical and Local Pharmaceutical Services) Regulations 2023, via a referral to NHS Resolution.
Fitness to practise and counter fraud investigations
We assisted a pharmacy client subject to investigation by the General Pharmaceutical Council and NHS Counter Fraud Authority in relation to multiple alleged offences of fraud and dispensing errors. We assisted the client with the gathering of relevant evidence, advised as to their defences and the appropriate strategy for the interview under caution. The regulators ultimately preferred his evidence over the informants and took no further action. Any conviction or finding of misconduct would have impacted upon the ability of the client to continue as owner and superintendent pharmacist within their pharmacies and would have had wider ramifications for the employees across the branches.
Dispute resolution
Further to the division of a pharmacy business, we assisted our client to pursue a claim against his former business partner for a breach of the agreement reached regarding the division.
