How Will a Claim Begin?

If you would like us to investigate a claim on your behalf then we will with your permission request your medical records. These will be needed by any expert we instruct on your behalf.

An expert will consider the care/treatment you have been provided and advise whether it fell below the standard that should be expected. An expert will also consider the future and advise if any further treatment is recommended.

We understand that rehabilitation is very important to clients and we will consider this as part of your claim. We can potentially ask the defendants to fund any rehabilitation or advise you on making a request for an interim payment.

Once we have all the evidence we can then look to negotiate a settlement with the defendants on your behalf. Any negotiations always involve you so you are fully aware of what is happening.
If someone sadly dies as a result of medical negligence, then we can help their Estate with pursuing a claim.


What Compensation Can I Claim?

Our medical negligence lawyers can advise on how much compensation you are likely to receive.

The compensation will be based on the evidence we obtain as to how the injuries will affect you at the time of settlement and into the future.

Compensation falls into two parts:

  • Compensation for injuries - The compensation for injuries will be based on previous cases that are similar to the situation you have encountered.  We can advise you about how much you are likely to receive as your claim progresses.
  • Compensation for financial losses - Loss of earnings is a major part of many claims and can be claimed if the medical report supports the fact that you are unable to work due to the defendant's negligence. The injured person can also potentially claim for travel expenses and private medical costs, provided they are related to the injury caused by the medical negligence. Compensation can also be claimed for the cost of care which has already been provided. We can also claim for care for the future as well as any necessary adaptions to your accommodation or any specialist equipment needed to allow you to live independently in your own home.

Inquests

If, tragically, somebody dies as a result of medical negligence then there will be an inquest into his or her death.

Our expert medical negligence solicitors can arrange representation and provide legal advice for families at inquests in the Coroners Courts. As experts in our field we can make sure you get the answers you are entitled to from the coroner's investigation.


How Can I Pay My Legal Costs?

The thought of how to pay legal costs can be a major concern.

We offer a "no win, no fee" agreement in cases where we consider there are good prospects of succeeding with the claim. If the case does not succeed then there is nothing for the client to pay in legal costs. If the case succeeds, a percentage of the compensation awarded is deducted, but only if a case is successful and no more than 25% would be deducted.

We work in partnership with a leading legal expenses insurer to provide a no win no fee product that gives you complete peace of mind regarding the cost of your claim.

You may also have legal expenses insurance under a home insurance policy or a bank account or credit card. You may also be a member of an organisation which provides legal costs cover. We can explore this with you to ensure that the best possible means of funding your case is adopted.
