Vento bands are named after the case in which the guidance was first set out (Vento v Chief Constable of West Yorkshire) and are used to assess compensation for injury to feelings and psychiatric injury in discrimination and whistleblowing claims.
For claims presented on or after 6 April 2022, the new Vento bands are as follows:
In the most exceptional cases it will be possible for tribunals to award in excess of £49,300. It is for Tribunals to determine which band a case falls into, and where in the band it should sit. The guidance is not binding, but Tribunals must have regard to it and in practice it would be highly unusual if the Vento bands were not followed.
