VWV Hosts Successful 'Mock Trial' Event at the Library of Birmingham

We joined forces with Radcliffe Chambers and The Association of Contentious Trust and Probate Specialists (ACTAPS) last Thursday to host a 'mock trial' in the iconic Library of Birmingham.

The event, supported by speakers from Radcliffe Chambers, provided an opportunity for contentious and non-contentious practitioners to explore a case and raise questions about courtroom practice, before a verdict was made.

The evening's case revolved around the Court of Protection and Mental Capacity Act, and focused on the legal challenges which can arise where a client's capacity is in question.

'Jack', whose capacity was in question, had handwritten a Will which 'Peggy', Jack's wife, argued was not in his best interests, and wished for a statutory Will to be made instead. On the other hand,  'Tony', Jack's son, who was left Jack's entire estate in the hand-written Will, fought against a statutory Will being drafted.

The guest judge for the evening, Piers Feltham, a leading junior at the Chancery Bar, questioned both sides on their arguments, and their supporting case law, before putting the final decision to a vote. After a hotly-contested trial, the decision ended in a draw.
