Discrimination Claims - New Compensation for Injury to Feelings

From 11 September, new 'Vento' bands will be applied to calculate compensation for injury to feelings and psychiatric injury in discrimination claims.

The bands take their name from the case in which the guidance was first set out - Vento v Chief Constable of West Yorkshire.

The new bands will be as follows:

  • lower band, for less serious cases, such as where the act of discrimination is an isolated or one off occurrence: £800 to £8,400

  • middle band, for serious cases, which do not merit an award in the upper band: £8,400 to £25,200

  • upper band, for the most serious cases, such as where there has been a lengthy campaign of discriminatory harassment: £25,200 to £42,000

  • exceptional cases: over £42,000

It is envisaged that the values attributed to the bands will now be reviewed on an annual basis.
