The controversial practice of "fire and re-hire" has garnered media attention over the past few years, not least in light of the controversial actions taken by P&O Ferries in dismissing some 800 staff with no prior warning.
In response to public concern surrounding the incident, the government committed to publishing a Statutory Code of Practice on fire and re-hire (or dismissal and re-engagement) practices. The first draft of the Statutory Code was published for consultation early last year. The updated draft has now been issued and is expected to be in force by this summer.
Employers will need to understand the scope of the new Statutory Code before it comes into force. In particular, it will be important to consider its practical impact on consultation procedures, as well as the potential consequences of an unreasonable failure to follow the Code. This session will examine the key features of the Code and what they mean in practice. It will also include practical tips for employers and highlight areas of potential risk.
