Vacant possession is a term which many people think is a matter of common sense. However, it has been a frequent source of disputes in property transactions and can have significant implications for the unwary. We will look at some of the recent decided cases in the context of break clauses and consider ways of avoiding problems.
Legal Alienation
Applications for licence to assign or sublet are often unwelcome to landlords who want advice about whether they can refuse or what conditions they can impose before agreeing. Conversely, tenants often find it frustrating if they wish to dispose of a lease but cannot get the landlord to commit to consent. We will look at what constitutes unreasonable refusal or delay, what conditions a landlord can impose and when a tenant is entitled to proceed on the basis that consent has been given, even if the landlord thinks it has not.
