Emily works in our private client team and specialises in disputes between cohabiting (unmarried) couples and also contentious probate matters. Emily has experience of acting for clients in relation to bringing and defending TOLATA (Trusts of Land and Appointment of Trustees Act 1996) claims, which involve claims relating to constructive trusts and proprietary estoppel. She is able to assist with cohabitation agreements, separation agreements and legal advice for unmarried couples.
Emily also has litigation experience in disputes arising out of family partnerships, trusts, wills and contentious probate. She has worked on challenges against the validity of wills and claims under the Inheritance (Provision for Family and Dependants) Act 1975, including claims on behalf of spouses, cohabitees, protected parties & adult children. Often these claims have involved an understanding of the structure of the family business and assets which had previously been sold and the unravelling of various agreement reached between family members.
Emily has been successful in settling many cases for clients by way of attending mediation in respect of both cohabitee disputes and contentious probate claims.
