Kelly is an experienced insolvency Associate, who regularly assists insolvency practitioners ('IPs'), partnerships, companies and individuals with matters that require specialist restructuring and recovery advice. She is well placed to advise on contentious and non contentious insolvency matters and will always look for ways of resolving the issues faced by her clients.
Kelly is also a highly effective commercial litigator and has a wealth of experience advising private and corporate clients, public bodies and educational institutions on a range of commercial disputes including: partnership law, guarantee claims, contract law and complex or high value debt recovery matters.
Since joining the team in 2011, Kelly has advised and assisted IPs with a wide range of claims against directors and other parties (including preferences, transactions at an undervalue, breaches of directors duties, misfeasance, unlawful dividends and asset recovery). Kelly also has experience in obtaining freezing injunctions in order to safeguard assets on an urgent basis.
Kelly's experience of working closely with IPs means that she fully understands the antecedent transaction claims that former directors may find themselves having to justify and defend following the formal insolvency of their company. Kelly is well versed with the tactics that an IP may adopt in pursuing these claims and is experienced in successfully defending/settling such actions, including those initiated by the Secretary of State in respect of directors' disqualification proceedings.
Kelly also assists and advises on the administration process, the voluntary winding up of insolvent/solvent companies and has assisted countless creditors in petitioning for the compulsory winding up of debtor companies. She has also advised a number of creditors who have sought to enforce their retention of title against insolvent companies to recover unpaid stock worth millions of pounds in order to minimise their losses.
Kelly is also experienced in all matters of personal insolvency from the initial stage of petitioning for an individual's bankruptcy, right through to assisting trustees in bankruptcy realise or recover bankruptcy assets (including applications for possession and sale). She is also experienced in defending statutory demands/bankruptcy petitions, assisting bankrupt individuals to secure bankruptcy annulment orders and advising parties on their ability to assert equitable rights in bankruptcy assets (for example, in the family home).
